Analisis Maqashid Syariah Dalam Regulasi Perlindungan Konsumen Terhadap Produk Makanan Tanpa Sertifikat Halal
"This study aims to analyze the provisions of regulations for
Muslim consumer protection for food products without halal
certification in Indonesia and to determine the alignment of
these regulations with the maqashid sharia for food products
without halal certification.
This study uses a juridical normative method. The normative
method is used to examine applicable laws and regulations,
specifically Law Number 8 of 1999 concerning Consumer
Protection and Law Number 33 of 2014 concerning Halal
Product Assurance, as well as their derivative regulations.
The data obtained are then analyzed using the Maqashid
Sharia framework, which encompasses five main objectives:
Hifz al-Din, Hifz al-Nafs, Hifz al-‘Aql, Hifz al-Nasl, and Hifz
al-Mal.
The study shows that existing regulations aim to protect
Muslim consumers, but in practice, there are still gaps in
ensuring the protection of Muslim consumers for products
without halal certification. Weak oversight is a factor
preventing the Maqasid Sharia principles from being fully
realized in existing policies. Therefore, stricter oversight is
needed to ensure that existing regulations align with the
primary objective of Islamic law, namely safeguarding the
welfare of the community.
