Analisis Maslahah Terhadap Tata Kelola Hak Merek (Studi Kasus Sengketa Merek Etawaku PT. Ethos Kreatif Indonesia VS imam Subekhi)
"Goal : This study examines the governance of trademark rights from the
perspective of maslahah through a case study of the “Etawaku” trademark
dispute between PT. Ethos Kreatif Indonesia and Imam Subekhi.
Methode : Using a qualitative approach through document analysis and expert
interviews.
Fact/Finding: The study finds that the registration of the trademark without the
business partner's consent, while legally valid, violates the Islamic principle of
trust (amanah). The court’s decision to revoke the trademark registration aligns
with the principle of maslahah by upholding justice and preventing harm. These
findings highlight the importance of ethical considerations in trademark
protection to ensure harmony between legal frameworks and Sharia values."
