Analisis Regulasi TKDN Pada Produk Iphone 16 Dari Pespektif Keadilan Dalam Hukum Ekonomi Syariah
Goal : This research aims to analyze the Tingkat Komponen Dalam Negeri (TKDN) or Local Content Requirements (LCR), regulation for iPhone 16 in Indonesia from the perspective of justice in Sharia Economic Law. The TKDN regulation, which requires electronic products to have a minimum of 40% local content to be sold in Indonesia, aims to encourage the growth of domestic industries and reduce dependence on imported products. Methods : This research uses a qualitative approach with the type of case study and literature study. Primary data is obtained from analyzing official documents and reliable online news, while secondary data comes from academic literature, journals, and related articles. The focus of this research is to explore how the TKDN policy is understood and implemented by stakeholders (government, industry players, and consumers) and assess whether its implementation is in line with the values of justice in Sharia Economic Law. Fact/ Finding : The results show that the implementation of the TKDN regulation for the iPhone 16 has several negative impacts, the main ones being a decrease in local production capacity, component quality that does not meet international standards, and a decrease in Apple’s investment in Indonesia. Basically, TKDN operates in accordance with sharia economic law, which aims to create distributive prosperity through the protection of local industries and the expansion of the labor market. However, the implementation in the iPhone 16 case has not fully embraced the principle of justice, as the benefits to local industries have not been fully realized, while consumers have limited access to the product due to its high price and quality assurance.
