Analisis Komparatif Regulasi Sanksi Terhadap Muzakki Yang Lalai Menunaikan Zakat: Studi Undang-Undang Zakat Di Sudan Dan Indonesia
"This study aims to conduct a comparative analysis of sanction
regulations for muzakki (zakat payers) who neglect to fulfill
their zakat obligations under the legal systems of Sudan and
Indonesia. Zakat, as a mandatory practice in Islam, holds
both religious and social dimensions and is governed by
national laws in many Muslim countries. Sudan enforces
strict legal sanctions against non-compliant muzakki,
whereas Indonesia emphasizes a persuasive and educational
approach
The study explores the legal foundations for sanction
implementation, including statutory bases in each country,
the types of sanctions applied (administrative, criminal, or
social), and the mechanisms for legal enforcement. The
findings reveal that Sudan’s regulation is more binding and
grants enforcement powers to zakat authorities to penalize
negligent muzakki. In contrast, Indonesia's regulation is more
advisory in nature, relying heavily on public awareness and
voluntary participation.
Both countries share the recognition of zakat as a religious
and social duty and aim to integrate zakat into their national
legal systems. However, the main difference lies in the
approach and legal enforcement toward non-compliance. The
