Analisis Akad Pada Fitur Paylater Sebagai Metode Pembayaran Di Aplikasi Shopee Ditinjau Dari Perspektif Hukum Islam

"Goal : This research aims to determine the mechanism of using the Shopee
Paylater payment method, which then examines the suitability of Shopee Paylater
with the principles of Islamic law in terms of qardh and riba contracts and from
the perspective of maqashid syariah.
Method : The research method used in this research is qualitative, with library
research and documentation techniques obtained from books, journals, and other
literature sources.
Fact/Finding : This research shows that there is a discrepancy between the
Shopee Paylater payment method and the principles of Islamic law. From the
perspective of the qardh contract, Shopee Paylater has fulfilled the pillars and
conditions of qardh. However, in practice, there is a discrepancy with the qardh
contract due to the presence of installment interest and additional fees that
contain elements of usury. From the perspective of maqashid syariah, although
Shopee Paylater provides convenience to users, its practices contradict the five
aspects of maqashid syariah because they are not in line with the primary
objectives of Islamic law in safeguarding the public interest.
