"This study aims to reformulate the Sangkolan tradition from
the perspective of inheritance law and compare it with the
concepts of gifts and wills. The gift of property by parents to
their children in the Sangkolan tradition is a form of affection
and is considered fair according to custom. However, from
the perspective of Islamic inheritance law, there is a lack of
harmony as to whether this tradition is a gift or a will, or
even neither.
: This study examines the Sangkolan tradition, which, in its
implementation of the distribution of property from parents
to children, contains elements of both gifts and wills, but does
not adequately fulfill all the elements of either. This creates
confusion regarding the compatibility of inheritance
distribution using the Sangkolan tradition with Islamic
inheritance law in accordance with Islamic jurisprudence.
