Tanggung Jawab Franchisor Dalam Perjanjian Waralaba Perspektif Maqashid Indeks ( Studi Kasus D'Besto Chiken And Burger PT. Evalinda Berkah Mandiri
"Goal : This study aims to analyze the responsibilities of the franchisor in a investor agreement from the perspective of the maqashid index, using a case study of
the d‟Besto Chicken and Burger investor, managed by PT Evalinda Berkah Mandiri. The research highlights the importance of integrating legal compliance,
business principles, and Sharia values in investor partnership practices in Indonesia.
Method : This is a qualitative research employing a descriptive-analytical approach based on the maqashid index framework, which refers to the theory of
maqashid syariah as conceptualized by Al-Ghazali and Asy-Syatibi. Data were
collected through interviews, field observations, and documentation, and were
analyzed descriptively to gain a comprehensive understanding of the franchisor‟s
responsibilities in investor agreements and their alignment with Sharia principles.
Fact/Finding : The findings indicate that PT Evalinda Berkah Mandiri, as the
franchisor, has fulfilled its responsibilities comprehensively towards its investor
partners. The partnership model implemented reflects the forms of syirkah inan
and syirkah abdan, with profit-sharing based on a break-even point system and
without imposing investor or royalty fees. The franchisor also demonstrates a
strong commitment to the five core principles of maqashid syariah: the protection
of religion, life, intellect, lineage, and property. These principles are reflected in
the management of halal products, social security for employees, skill training,
fulfillment of labor rights, and financial transparency. This partnership model
emphasizes not only profitability but also spiritual and social benefits aligned
with Islamic values."
