Analisis Intensi Mulslim Indonesia dalam Memberikan Hak Atas Kekayaan Intelektual Digital Untuk Wakaf Produktif
Background: Waqf has received attention from religious organizers in Indonesia
since the era of independence and its development continues to increase every year,
but the understanding of the people in Indonesia about waqf objects is still limited
to immovable objects. In the last two decades, the law of waqf jurisprudence has
undergone extraordinary evolution, one of which is the recognition of intellectual
property as an object of waqf as part of the type of movable objects in the form of
intangible assets and can be managed into productive waqf. In practice, in
Indonesia, there has been no management of Intellectual Property Rights as a
productive waqf object, while there are already many digital-based intellectual
property products on the Internet.
Goal: This study aims to analyze the factors that influence the intention of Muslims
to grant rights to their digital intellectual property as Intellectual Property Rights
(IPR) in productive waqf programs using the Theory of Planned Behavior (TPB)
model approach.
Methode: The data analysis method in this study uses Structural Equation
Modeling (SEM). The determination of the sample in this study uses a nonprobability sampling technique with a purposive sampling type or consideration
sample. The data used in this study are primary data, namely from the answers of
respondents to the questionnaire conducted in 2022 with the specified criteria.
Fact/Findings: The results of this study indicate that three factors in the TPB
theory, namely attitudes towards behavior, subjective norms, and perceptions of
behavioral control have a significant positive influence on a person's intention to
grant rights to their digital intellectual property as Intellectual Property Rights
(IPR) in a productive waqf program. Based on the findings, it can be concluded
that attitudes towards behavior are the main driving factor that influences a Muslim
in granting rights to digital intellectual property to be managed as productive waqf
and this can be a stimulus for waqf institutions in Indonesia to develop waqf
property programs in the form of digital assets.
